Grove City Officials: No Indictments from Grand Jury

The Delaware County Grand Jury issued a second partial report Monday morning finding for "no indictment" in another seven allegations made against Grove City Manager Bill Galletly. In addition, the report found for no indictments against City Councilors Dave Helms and Mayor Carolyn Nuckolls, as well as no indictment for former city attorney Dorothy Parker, on two allegations.

Chief Prosecutor Gene Haynes said "this pretty much clears up the Grove council and manager issues and this week we will move on to other submissions."

Specific allegations and the jury's findings include:
Allegations of the Petition:

--violations of the Public Competitive Bidding Act of 1974. This Grand Jury has found no additional evidence of said violations that has not already been litigated. No indictment.
--exceeding budgetary appropriations of the Council. This Grand Jury has found no evidence supporting the allegations that the budget was exceeded in violation of the statute. No indictment.
--violation of constitutional rights of Petitioner Earl Barnes, David E. Shero, Jack L. Smith, and Gary Metcalf by William Galletly. Pursuant to legal advice from our advisor, there is no criminal penalty associated to this allegation. No indictment.
--violations of Open Meeting Act against Galletly, Helms, and Nuckolls. This Grand Jury finds that no violation of the Open Meeting Act occurred. No indictment.
--Failure to supervise as per their oath, against Helms and Nuckolls. Pursuant to legal advice from our advisor, there is no criminal penalty associated to this allegation. No indictment.
--Nuckolls and Helms harassed and voted to not reappoint a board member that reported their illegal GIDA meetings to the public. This Grand Jury found no evidence supporting this allegation. No indictment.

Allegations not contained within the petition:

--Open Meeting Act violations by Dorothy Parker. Only members of a "public body" as defined in the Open Meeting Act are subject to the requirements of the act. Dorothy Parker was an employee of the City but was not a member of any board or council, nor is she an elected official. No indictment.
--Embezzlement of public funds by Dorothy Parker. This Grand Jury has found that Mrs. Parker did not have direct access to any public funds. Furthermore, this Grand Jury heard evidence that the Grove City Council voted to pay billing invoices that were submitted to the council by Mrs. Parker. No indictment.
--conspiracy by Dorothy Parker and William Galletly. This Grand Jury has found no evidence supporting the allegations of conspiracy. No indictment.
--embezzlement by William Galletly. This Grand Jury has found no evidence supporting the allegations. No indictment.
--violations of the Oklahoma Constitution by Galletly and City Council, regarding council agenda item on the ESPN Bass Tournament and council voting to appropriate funds to the Grand Lake Association ($75,000). There is an opinion written from the Attorney General that allows for this under certain circumstances. One such circumstance is for the promotion of economic welfare. This Grand Jury finds no evidence of violation of the Oklahoma Constitution and we find that no indictment can issue against Mr. Galletly and the Grove City Council on the allegations.
